Town of Vail to present tough new compliance agreement with Comcast

The Vail Town Council will consider a resolution approving a compliance agreement between the Town of Vail and cable provider Comcast during its evening meeting on Tuesday, Sept. 20.

The item is listed fifth on the meeting agenda and public comments will be taken. The meeting begins at 6 p.m. in the Vail Town Council Chambers, 75 S. Frontage Rd.
The proposed compliance agreement outlined in Resolution No. 18, Series of 2011, follows an independent audit of the Comcast cable system that identified up to 2,500 technical violations of the franchise agreement, including damaged pedestals, cables and faulty wiring. The audit was conducted by Jonathan Kramer, a telecommunications consultant based in Los Angeles. Since then, Comcast has been working to remedy the violations and to negotiate the compliance agreement with the town. Highlights of the draft agreement include:

Comcast pays the Town of Vail $25,000 to cover the cost of the audit and legal fees associated with the audit and the negotiation of the compliance agreement;
Comcast agrees to remedy the majority of the issues noted in the audit report by Dec. 31, 2011;
Comcast is subject to liquidated damages for failure to comply with the compliance agreement;
Comcast must maintain the current $50,000 letter of credit until a new franchise agreement is approved.

Comcast has been providing cable service to Vail subscribers on a month-to-month basis following expiration of the franchise agreement on Jan. 4, 2010. The company has since requested renewal of the franchise. However, those negotiations have been suspended until the company can show compliance with the agreements currently in place.

Comcast representatives will be at Tuesday's meeting to answer questions from the Town Council and the public.
